A rough translation of our Website Statute
Statute – a set of provisions regulating the provision of the Interior and/or Garden Design service.
Client – an adult person or legal entity contacting us via the form available on the website www.projectmik.com or by e-mail: biuro@projectmik.com, biankakopejkin@gmail.com or by phone: +48 883936680
Designer/Service Provider – a person who prepares an Interior and/or Garden Design using their skills and qualifications, in accordance with their best knowledge of the designed space, provided by the Client and in accordance with the preferences clearly specified by the Client.
Interior and/or Garden Design – an individual and unique concept for the appearance of an interior and/or garden, prepared by the Designer, upon request and in accordance with clearly defined guidelines by the Client, and presented in the form of a Graphic Design, provided to the Client in electronic form.
Graphic Design – a graphic file used to present, introduce Changes and Corrections and reproduce part or all of the Interior Design Design in one of the following formats: *.PDF, *.JPG, *.PNG, *.GIF.
Design Change – introducing a reorganisation of part of the Interior and/or Garden Design, requiring a significant amount of work on the part of the Designer (e.g. a complete change of arrangement of a given piece of equipment, changes in the functional and spatial layout, changing the function of individual rooms, e.g. from a previously designed study to a children’s room).
Design Correction – introducing a reorganisation of part of the Interior and/or Garden Design, requiring minimal work by the Designer (e.g. changing the colour or texture of a given piece of equipment, changing a series of tiles in a given room, changing a particular element of the space, e.g. furniture or a lamp).
Preliminary Design/First Concept – the initial version of the Interior and/or Garden Design, created based on consultations with the Client.
Business days – every day from Monday to Friday, excluding public holidays in the Republic of Poland.
Floor Plan – a spacial plan based on which the interior design is created, either received by the Client during the roperty purchase process or created independently by the Client, strictly in accordance with the guidelines contained in the Measurement Instructions document, available on the website www.projectmik.com.
Price - the amount (expressed in PLN) constituting the remuneration for the implementation of the Interior Design and/or Garden Design. The remuneration is paid by the Client to the Service Provider in accordance with the Agreement or Arrangements (e.g., via email).
Contract – a document signed by the Client in accordance with the arrangements made between the Client and the Service Provider.
Agreements – correspondence between the Client and the Designer/Service Provider via email and/or SMS/MMS messages and/or other means of communication that are legally binding and obligate the parties to respect them.
Administrator – the entity storing the Customer's personal data – Matyja i Kopejkin Sp. z o.o.

The Service Provider is not responsible for the construction project completion time based on the Interior Design and/or Garden Design ordered by the Client, but solely for the timely completion of the Interior Design Project stages previously agreed upon with the Client and included in the contract. Any delay by the Client in completing the stages beyond their control will result in an extension of the overall execution time, and therefore the completion of the Interior Design and/or Garden Design.
The Service Provider undertakes to send the Client undamaged files.
The Service Provider is not responsible for any technical issues the Client may encounter while opening files sent by the Service Provider to the Client via email. In justified cases, project documentation may be delivered to the Client on an electronic medium (e.g., CD).
Any claims or disputes between the Service Provider and the Customer arising from or related to the use of the www.projectmik.com portal, which the parties are unable to resolve amicably, will be submitted for final resolution to the court having jurisdiction over Matyja i Kopejkin Sp. z o.o., unless the Customer is a consumer within the meaning of the Civil Code.
The Interior Design and/or Garden Design project is implemented based on the parties' agreements. If the Client fails to respond to the Service Provider's inquiries for more than two months, despite the Service Provider's two requests for a response, the Client will be deemed to have withdrawn from further cooperation. In such a case, the Service Provider will charge the Client for the cost of the work performed to date, issuing and sending the appropriate invoice to the Client.
The Client accepts that the appearance of the project, in particular the colors of the materials used, color saturation, contrast, etc., may vary slightly depending on the monitor settings.
The Client accepts the fact that computer visualization of space is intended only as an illustrative presentation of the project and, despite the photorealistic effect, does not always allow for a faithful representation of reality.
Matyja i Kopejkin Sp. z o.o. reserves the right to modify these Terms and Conditions. All information regarding changes to the Terms and Conditions will be published on the website www.projectmik.com and will apply to orders placed after these changes have been made.
These Regulations apply from January 1st, 2022
Contacting the Service Provider via the form available on the website www.projectmik.com is voluntary.
Providing personal data in a message to the Service Provider is voluntary.
The Service Provider is not responsible for the consequences of the Customer providing false or incorrect data in the sent message.
By accepting the Regulations, the Customer consents to the collection and processing of his/her personal data for the purpose of: presenting the offer, fulfilling the order (Article 6 paragraph 1 letter b of the GDPR), using them for accounting purposes (Article 6 paragraph 1 letter c of the GDPR) and for archival and statistical purposes (Article 6 paragraph 1 letter f of the GDPR).
The Administrator of the Customer's personal data within the meaning of the Personal Data Protection Act is Matyja i Kopejkin Sp. z o.o. with its registered office in Siechnice, at ul. Marsz. J. Piłsudskiego 22/13, 55-011, NIP: 8961599723, REGON: 387748483 KRS: 0000874848
Pursuant to Art. 38 points 1 and 2 of the Act of 30 May 2014 on Consumer Rights, the right to withdraw from a contract concluded away from business premises or at a distance does not apply to the consumer in relation to contracts "for the provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the commencement of the service that after the entrepreneur has performed the service, the consumer will lose the right to withdraw from the contract" and "in which the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or intended to meet their individual needs.
In accordance with the above, the Client has the right to withdraw from the contract until receipt of the First Concept in the form of the Graphic Design that is the subject of the order, but no later than within 14 days of concluding the Contract.
After receiving the final form of the Interior Design and/or Garden Design, the Client has the right to file a complaint.
Each complaint is considered individually.
When submitting a complaint, the Customer indicates specific deficiencies, errors or inconsistencies with previous arrangements that took place via e-mail and/or SMS/MMS messages and/or other means of communication and that were concluded in the Agreement or Arrangements.
The Client has the right to submit a complaint within 2 years from the date of receipt of the final form of the Interior and/or Garden Design.
The Service Provider is obliged to consider the complaint within 30 working days from the date of receipt of information about it.
If the Client's complaint is deemed justified, the Service Provider will allow the Client to make further changes to the Interior Design and/or Garden Design, sufficient to completely resolve the issue that is the subject of the complaint. In all cases, the Client and the Service Provider will endeavor to resolve the matter amicably.
In the case of Customers who are consumers within the meaning of the Civil Code, the Service Provider, as the seller, is liable to the Customer for any non-compliance with the sales agreement of a project purchased by that Customer, to the extent specified in the Act of 27 July 2002 on specific terms and conditions of consumer sales and amending the Civil Code (Journal of Laws of 2002, No. 141, item 1176, as amended). For the avoidance of doubt, it is stated that none of the provisions of the Terms and Conditions limit the rights of the Consumer under the provisions of applicable law in the territory of the Republic of Poland. If such a provision is found to exist, the provisions of the law in force in the territory of the Republic of Poland shall apply, in particular the Civil Code, the Act of 2 March 2000 on the protection of certain consumer rights and on liability for damage caused by a dangerous product (Journal of Laws of 2000, No. 22, item 271, as amended) and the Act of 27 July 2002 on specific terms and conditions of consumer sales and amending the Civil Code (Journal of Laws of 2002, No. 141, item 1176, as amended).
The order and the entire process of implementing the Interior and/or Garden Design may only be carried out in accordance with the principles set out in this Statute.
Each Interior Design and/or Garden Design created at the Client's request constitutes a work within the meaning of copyright law.
The Designer is not responsible for measurement errors or any other errors contained in the materials sent by the Client, in particular in the Plans and other technical drawings.
All Arrangements between the Client and the Service Provider are made via e-mail and/or SMS/MMS messages and/or other means of communication, which constitutes documentation of their cooperation and is binding on the parties.
The Designer grants a license for non-commercial use and distribution of the work, which is the Interior and/or Garden Architecture Design, in the scope of carrying out renovation and/or finishing works, showing the work to contractors and bidders and publishing the work or parts thereof on social media, citing the Designer as the author, on the basis of the Act of 4 February 1994 on Copyright and Related Rights of the Law of the Republic of Poland.
